Smith Haughey Prevails on Appeal

In Hooker v Moore, 2018 WL 6517607 (Dec 11, 2018), the Michigan Court of Appeals ruled in favor of Smith Haughey client Jeremy Hooker. Mr. Hooker had submitted a petition to recall the Muskegon County Drain Commissioner. The Board of State Canvassers (Board) determined that the recall petition was factual and sufficiently clear, and the Drain Commissioner appealed, arguing that the petition was improper. Smith Haughey attorney Kevin Even handled the appeal, and persuaded the Michigan Court of Appeals to uphold the Board’s determination. This victory will make it easier for the public to initiate the recall process.
