Smith Haughey Obtains Appellate Victory

Smith Haughey attorney Chris Berry and a trial team from the firm’s Muskegon office successfully represented our client, a local township, in a recent case before the Michigan Court of Appeals. The trial court had entered judgment against our client. Smith Haughey appealed the decision, seeking a peremptory reversal of the trial court’s decision. Such an appeal is very difficult to win, because it requires a panel of appellate judges to unanimously find that the action taken by the trial court was so erroneous that it must be reversed immediately, even before the submission of appellate briefs or oral argument. Despite this uphill battle, Smith Haughey prevailed on behalf of our client. Not only did the Court of Appeals vacate the judgment against Smith Haughey’s client, but it also assessed costs against the party that obtained the judgment.
